Common FAQs for EOR/PEO

An Employer of Record (EOR) service enables companies to legally employ staff in Malaysia without establishing a local entity. The EOR takes on all employment-related legal responsibilities such as payroll management, employee benefits, and compliance with Malaysian employment laws. Similarly, a Professional Employer Organization (PEO) provides extensive HR services through a co-employment model, sharing employer responsibilities with the client. Both services allow businesses to manage and expand their workforce in Malaysia efficiently, ensuring compliance with local regulations.

EOR and PEO services are ideal in scenarios such as:

  • Quickly entering the Malaysian market without the hassle and expense of setting up a local company.
  • Employing staff in Malaysia where your company does not have a physical office or entity.
  • Streamlining HR operations across different regions within Malaysia to ensure consistent and compliant HR practices.
  • Managing the complexities of Malaysian employment legislation, payroll, and taxation effectively.
  • Concentrating on strategic business growth while delegating routine and complex HR tasks to specialists.

Using EOR and PEO services in Malaysia provides significant benefits:

  • Rapid Market Entry: Facilitate quick hiring and operations setup in Malaysia, allowing your business to respond promptly to market opportunities.
  • Compliance Assurance: Mitigate risks by ensuring all employment practices comply with Malaysian laws and regulations, handled by experts familiar with local requirements.
  • Cost Efficiency: Reduce overheads associated with establishing and maintaining a legal entity in Malaysia, as well as streamline HR and administrative expenses.
  • HR Expertise: Access specialized HR knowledge and support tailored to the Malaysian market, covering everything from payroll to compliance with local labor laws.
  • Business Agility: Adapt to the dynamic Malaysian market with the ability to scale your workforce up or down without the typical legal and financial constraints.

A PEO will typically handle contributions to the Employees Provident Fund (EPF), Social Security Organization (SOCSO), Employment Insurance System (EIS), Potongan Cukai Bulanan (PCB) income tax deductions for the company, and Human Resource Development Fund (HRDF), if applicable.

No. You retain control over your employees’ day-to-day work, performance management, and business decisions. The PEO / EOR only handles the administrative HR and takes on all employment-related legal responsibilities such as payroll management, employee benefits, and compliance with Malaysian employment laws.

There are a few key differences between the two. Traditional HR outsourcing typically involves contracting specific HR functions such as payroll to a third party. A PEO/EOR involves we becomes the employer of record for the company and handling the HR operational task.

PEO/ EOR can provide support for foreign companies expanding into Malaysia by hiring the employees under our company, handling local employment laws, payroll, taxes, and other HR-related tasks while the foreign company focus on establishing its business operations and without setting up a legal entity in Malaysia.
